1. Acceptance of Terms
By accessing and using ShopifySuperHero ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. TheAISuperHeroes ("Company," "we," "our," "us") reserves the right to modify these terms and conditions at any time. Your continued use of the Service following the posting of revised terms means that you accept and agree to the changes.
2. Description of Service
ShopifySuperHero is an AI Agent Marketplace Platform that enables users to discover, integrate, and manage AI agents for various business automation purposes. The Service includes:
- Access to a curated marketplace of AI agents
- Subscription-based access to premium agents
- API integration capabilities
- User dashboard for agent management and monitoring
- Customer support and documentation
3. Account Registration
To access the Service, you may need to create an account. When creating an account, you must:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your password and account information
- Be responsible for all activities under your account
- Notify us immediately of any unauthorized use of your account
- Be at least 18 years old or have parental consent
You agree that TheAISuperHeroes is not responsible for any loss or damage arising from your failure to comply with these requirements.
4. Subscription & Billing
Subscription Plan
The Service is offered on a monthly subscription basis at $14.99 USD per month. Billing occurs automatically on a recurring monthly cycle.
Payment Processing
Payments are processed through Stripe. By subscribing, you authorize Stripe to charge your payment method for the subscription fee and any applicable taxes. You agree to maintain accurate and current billing information.
Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months. Upon cancellation, your access to paid features will terminate at the end of your billing cycle.
Refund Policy
All subscription fees are non-refundable except as required by law. For subscription disputes, contact us at partners@theaisuperheroes.com within 30 days of the charge.
5. Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of these terms. Prohibited activities include:
- Violating any applicable laws or regulations
- Engaging in harassment, threats, or abusive behavior
- Creating fraudulent or misleading content
- Attempting to gain unauthorized access to our systems
- Reverse engineering, decompiling, or otherwise attempting to derive source code
- Distributing malware or harmful code
- Scraping, data mining, or automated data collection without permission
- Reselling or redistributing the Service without authorization
- Using the Service to develop competing products or services
- Violating the rights of others (intellectual property, privacy, etc.)
We reserve the right to terminate accounts engaged in prohibited activities.
6. API Usage
Your subscription includes 1,000 API calls per month. Additional usage may be subject to overages or higher-tier plans.
Rate Limits
API requests are subject to rate limiting to ensure fair access. Excessive requests may result in temporary suspension of API access.
API Keys
You are responsible for maintaining the confidentiality of your API keys. Do not share your API keys with third parties. If you believe your key has been compromised, immediately regenerate it through your account dashboard.
Usage Monitoring
We monitor API usage to prevent abuse. Unusual activity patterns may trigger account review and potential suspension.
7. Intellectual Property Rights
The Service, including all content, software, and technology, is the proprietary property of TheAISuperHeroes or its licensors. All rights are reserved. You receive a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes only.
User Content
You retain ownership of content you submit through the Service. By submitting content, you grant us a worldwide, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the Service.
Trademarks
ShopifySuperHero, TheAISuperHeroes, and related logos are trademarks of TheAISuperHeroes. You may not use these trademarks without prior written permission.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:
- Implied warranties of merchantability or fitness for a particular purpose
- Warranty of title or non-infringement
- Warranty of accuracy or completeness of content
We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components. Your use of the Service is at your own risk. You assume all responsibility and risk for your use of the Service and the internet in general.
9. Limitation of Liability
IN NO EVENT SHALL THEAISUPERHEROES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR LOSS OF USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the limitation of liability, so this limitation may not apply to you.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- Any data associated with your account may be deleted
- We may retain your information as required by law
You may terminate your account at any time by contacting us or canceling your subscription through your account settings.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the United States for the resolution of any disputes.
12. Changes to Terms
